These Terms and Conditions ("Terms") govern your access to and use of the FuzeLabs app and related services (collectively, the "Service"). By creating an account, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
FuzeLabs provides a strength‑training application to plan, log, and analyze workouts, optionally integrating with Apple Health. Features may change over time as we improve the product, and certain features may be offered as beta or preview with limited reliability.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority, you may only use the Service with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
3. Health and Safety
The Service provides general fitness tracking and analytics and does not constitute medical advice. Always consult a physician before starting or changing any exercise program. Use the Service at your own risk. Stop using the Service and seek professional advice if you experience pain, dizziness, or other concerning symptoms.
4. Accounts and Security
- You are responsible for maintaining the confidentiality of your account and for all activity under it.
- Provide accurate, current information and promptly update it when it changes.
- Notify us immediately of any unauthorized use or suspected security incident.
5. Subscriptions and Billing
Certain features may require a paid subscription processed via Apple’s in‑app purchase (IAP) system. Prices are shown in the app and may change. Subscriptions renew automatically until cancelled in your Apple ID settings. Apple’s refund policies apply. We do not control or access your payment information.
6. Apple Health Integration
If you enable Apple Health, the Service will read or write only the categories you permit in Apple Health settings. Health data is used solely to power in‑app features such as workout logging and analytics and is not used for advertising or sold to third parties. You can revoke access at any time in Apple Health.
7. User Content
You may input workout data, notes, and other content ("User Content"). You retain ownership of your User Content. You grant us a limited license to host, process, and display User Content as necessary to operate the Service. You are responsible for the accuracy and legality of your User Content.
8. Acceptable Use
- Do not misuse the Service, interfere with its operation, or attempt unauthorized access.
- Do not upload unlawful, infringing, or harmful content.
- Do not reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
9. Intellectual Property
The Service, including software, designs, text, graphics, and logos, is owned by FuzeLabs or its licensors and is protected by intellectual property laws. These Terms do not grant any rights to use our trademarks or branding.
10. Feedback
If you submit feedback or suggestions, you grant us a worldwide, royalty‑free license to use and incorporate them without obligation to you.
11. Third‑Party Services
The Service may rely on third‑party services (e.g., Apple, Firebase) subject to their own terms and privacy policies. We are not responsible for third‑party services.
12. Beta Features
From time to time we may offer experimental or beta features that are provided "as is" and may change or be discontinued at any time.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Upon termination, provisions that by their nature should survive (e.g., IP ownership, disclaimers, limitations of liability) will remain in effect.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use information.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUZELABS AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO FUZELABS IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
17. Indemnification
You agree to indemnify and hold harmless FuzeLabs and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.
18. Governing Law
These Terms are governed by the laws of your country or state of residence, except where preempted by U.S. federal law. If you reside in the United States, the laws of the State of California (excluding conflict‑of‑laws rules) govern. Venue for disputes shall be the competent courts in the applicable jurisdiction.
19. Changes to Terms
We may update these Terms from time to time. Material changes will be notified in‑app or via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
